On the evidence and on the balance of probabilities the appellant suffered a work related personal injury on 13 March 2013 when the digger passed over a 0.5 metre rock causing a jolt; the appellant and corroborating witness were credible, medical evidence supported causation, therefore the review decision quashing ACC's acceptance was wrong, the revocation is set aside and cover is reinstated, with costs awarded and shared between ACC and Dusty Diggers.
