The April 2009 written quotations formed the contract, the quotations validly incorporated NZS 3915 by reference, there was no binding $100,000 oral contract at the initial meeting, the movement of the boat sheds was an engineer-directed variation agreed by the plaintiff and did not constitute a breach causing recoverable loss, only trivial remedial items remained (de minimis) and the breach of contract claim was dismissed; the judicial review of the adjudicator's decision was dismissed because the adjudicator correctly concluded NZS 3915 was part of the contract.
