The Court held there were serious arguable questions that Fullers was entitled to use the Otehei Bay wharf for commercial embarkation/disembarkation by virtue of the coastal permit conditions and that passengers disembarking were entitled to access the leased recreation reserve land for recreational purposes under the Reserves Act 1977; balancing the interests of justice and public interest the Court granted an interim injunction restraining Otehei (and assigns) from denying reasonable access, subject to conditions and protective payments until 19 May 2010.
