Decisions about removal of a deceased person from custody and arrangements for viewing are statutorily within the coroner's exclusive authority; absent directions from the coroner Police lacked lawful authority to move the body or impose conditions on cultural practices, and therefore any interference with NZBORA rights by Police in those functions could not be justified.
