Offers of out-of-zone places made in advance of a child's fifth birthday do not vest an irrevocable right to enrol prior to the date enrolment lawfully begins; a school may withdraw such offers in limited circumstances linked to the statutory purposes of enrolment schemes (notably avoidance of overcrowding) and the withdrawal in this case was a lawful and reasonable exercise of power.

Although DoC's statements overstated the law by asserting there was no basis for preferential entitlement and by suggesting economic benefits were irrelevant, the factual finding was that the DoC decisions did give effect to Treaty principles; because the litigation produced public interest clarification and all parties benefited, each party should bear their own costs.
