The Court has jurisdiction to hear an application under s 271 by a creditor whose claim has not been admitted or quantified; s 271 is not limited to claims admitted in the liquidation and the Court may, by leave and under s 307, determine the amount of an unquantified claim; accordingly the defendant's jurisdictional objection is dismissed and plaintiffs were granted leave to amend to invoke s 307 for assessment of quantum.
