The application was struck out because the High Court lacked jurisdiction to set aside the District Court default judgment and, crucially, the applicant failed to serve the creditor with the application within the 10 working days required by s17 and Form B2 so an act of bankruptcy occurred; the Court could not extend the statutory period and therefore the application was a nullity.
