The Court found there was a serious question to be tried on each pleaded cause (inducement of breach, unlawful means conspiracy, passing off, and s9 Fair Trading Act), that the second and third defendants likely had knowledge or constructive knowledge and engaged in conduct inducing breach and misleading customers, and that damages were inadequate given loss of opportunity and goodwill; on balance of convenience a limited interim injunction was necessary to allow the plaintiff a short period to approach former Vat Tech customers, so an interim injunction was granted until 5pm 28 October 2013.
