Leave to appeal was refused because the appeal raised no issue of general or public importance and involved the application of settled principles (notably Altimarloch and Murray) to the facts; the Court of Appeal was correct to conclude that the loss was suffered at settlement in 2005, rendering the claim time-barred, and there was no risk of substantial miscarriage of justice warranting further appeal.
