Holliday v Accident Compensation Corporation

- District Court
The Court preferred the treating surgeon Mr Malone's evidence on causation as credible and persuasive given immediate disabling symptoms, plausible high‑force eccentric mechanism, temporal connection and operative findings; accordingly the Court found the 24 June 2012 accident caused the rotator cuff pathology and allowed the appeal, overturning ACC's decline to fund the surgery.
