The application was a plain abuse of process because it sought to circumvent the Limitation Act by obtaining leave to commence proceedings out of time; time limitation is a defence not avoidable by a prefatory grant of leave, and accordingly the proceeding must be struck out under the High Court Rules.

Leave to commence the defamation proceeding was refused because the applicant did not apply within the six year leave period for the 10 March 2008 publication and, on the merits, the proposed proceedings are vexatious and an abuse of process such that it is not just to grant leave; additionally, allegations based on the 10 February 2012 brief were barred by absolute privilege and the applicant had not taken steps when aware of it.

Leave to bring the 2008 and 2009 defamation causes was refused because the applicant failed to demonstrate that the delay was occasioned by any reasonable cause; the 2011 claim for monetary relief is time-barred under the Limitation Act 2010, but declaratory relief in relation to the 2011 events is not subject to the statutory prescribed defence and therefore may proceed without leave.
