The High Court held the sentencing Judge did not err in classifying the offending within band two of R v Terewi and that a starting point of two years and four months was not plainly wrong; the guilty plea discount was correctly moderated because the appellant delayed pleading to challenge the search, no extra credit for good character was warranted given prior similar convictions, and a small bail deduction was unnecessary given the favourable substitution of imprisonment for home detention; accordingly the appeal was dismissed.
