Supreme Court held the Council owed a duty of care in respect of inspection and certification for building-code compliance not limited to owner-occupied residential homes; the claims alleging negligent inspection and negligent misstatement arising from code compliance certificates in relation to the Spencer on Byron mixed-use building were permitted to proceed and the High Court and Court of Appeal orders dismissing them were set aside.
