The Court awarded costs to the Real Estate Agents Authority on a 2B basis, accepting the Authority's time allocations except for the discrete step assessed on a 2A basis, and ordered payment of $19,478.50 plus disbursements of $590 by Ms Prasad.

Interim relief was granted because the cancellation would take immediate effect and there was no evidence of ongoing risk at the centre, the applicant's statutory-interpretation challenge was arguable, the balance of convenience favoured maintaining the status quo pending a prompt substantive hearing, and the respondent would suffer no prejudice from a short stay of the Gazette notice.

The High Court upheld cancellation because the appellant's unauthorised overnight occupation of a client property, subsequent dishonesty to the owner and police, attempts to procure corroboration, persistent misleading accounts during the disciplinary process, lack of insight and abrasive conduct demonstrated he was not a fit and proper person; personal stressors did not establish likely rehabilitation or justify a lesser penalty.

Interim relief was granted because the applicant demonstrated an arguable position to preserve (at least two available venues and legitimate interest), the relief sought was reasonably necessary and limited in duration, and discretionary factors (procedural fairness concerns about handling of s113 evidence, lack of demonstrated public harm from short delay, and manageable timetable) favoured preserving the status quo until the judicial review hearing on 22 September 2014.
