Certain drawings and prototypes created by the Careys were original artistic works and copyright subsists in specified features (sensor position/passive window; 1998 gate drawings and prototype including cover and gate closer; 1992 central carrier adjuster drawings; 2000 prototype and 2001 drawing of manual holder); Electroquip (by assignment) and Martin Carey own the relevant rights; Craigco Limited and Patrick Tuffin copied substantial parts of those works and infringed copyright; Mrs Tuffin is not personally liable; defendant s130 claim dismissed; relief to be determined at further hearing.
