Appeals dismissed. The appellant was not entitled to LOPE because he has no accepted cover for a personal injury suffered before age 18 and s317 does not create cover; the claim was lodged in 2004 so the pre-2005 version of s38 applies and the 1978 blood tests do not demonstrate he first sought or received treatment for Hepatitis C or its symptoms then; the deemed date of injury is therefore 21 August 1995 and the respondent's decisions of 4 April 2008 and 26 September 2008 are confirmed.
