The Court concluded there was a serious question to be tried that Siemens' contractual and LTMA confidentiality provisions could extend to the turbine and prohibit reverse engineering, that GE arguably knew of Siemens' claim and proceeded with purchase, and that the balance of convenience supported maintaining interim relief; accordingly the appeal was dismissed.
