GA v Accident Compensation Corporation (Mental Injury)
- Citation
- [2019] NZACC 1
- Court
- District Court
The Court held the covered physical injuries (left finger abrasion and right wrist contusion) did not materially contribute to the appellant's PTSD; the PTSD was caused by the traumatic event as a whole (and the appellant's pre-existing vulnerability) rather than by the insignificant physical injuries, and temporal coincidence alone was insufficient to establish causation under s26(1)(c); accordingly ACC's decision to decline cover and the Reviewer's dismissal were correct and upheld.
