The 9 December 2002 letter did not constitute a new reviewable decision because it did not raise a new question of causation distinct from that already determined; Dr Davis' report did not present new evidence on causation but only disputed the nature (mental vs physical) of the same disorder, and the earlier decision had already considered psychological explanations, so ACC was entitled to treat the letter as confirmation and not a fresh decision.
