The Court held that a Labour Inspector may commence and the Authority may determine a s 228(1) action even where employment status is disputed; the Authority has jurisdiction to decide status as an ingredient of the s 228(1) claim unless there has been an application under s 6(5) to the Employment Court, which is a complementary but not prerequisite route.
