The Court admitted the fresh affidavit evidence, found the PAC report contained material inaccuracies and unfair adverse characterisations that affected the sentencing Judge's decision on home detention, and concluded that, applying the correct facts and sentencing principles (including the least restrictive appropriate sentence), home detention for eight months was the appropriate substituted sentence.
