The Reviewer erred in discounting the combined effect of firm advice from an ACC officer that the appellant could not succeed and the appellant's anxiety and caring burdens; those factors together constituted extenuating circumstances under s135(3) that causatively prevented timely review of attendant care decisions made since 1 January 2002, so the late review applications are permitted.
