Because the defendant removed and supplied an operable firearm and also brandished a firearm in a large gang confrontation, a starting point of five years nine months imprisonment was appropriate; after discounts of seven months for personal mitigation, three months for time on restrictive EM bail and 20% (12 months) for a guilty plea, concurrent sentences were imposed producing an effective term of three years eleven months imprisonment, with remaining charges discharged under s 147 Criminal Procedure Act 2011.
