The appeal is dismissed: the High Court concluded the District Court did not err in finding the gravity of the offending, after mitigation for the appellant's dissociative identity disorder, was low to moderate and that the consequences of conviction (employment, travel, mental health) were not out of all proportion to that gravity; therefore a discharge without conviction was not warranted.

Leave to bring a second appeal was granted because there was a real risk of miscarriage of justice: the applicant raised a plausible case that the starting point may have been manifestly excessive and that the discount for mental health may not have been correctly calibrated, warranting appellate examination.

The High Court held the District Court did not err: the combined starting point and discounts were within acceptable bounds, intensive supervision was not a realistic least restrictive option given the appellant's lack of stable address and history of non‑compliance, and imprisonment for six months was justified as the appropriate and least restrictive sentence available to protect the community and facilitate rehabilitation.

Judge held the offender's chronic and acute sleep deprivation produced a seriously disturbed mental state that substantially reduced moral culpability. Applying precedents and statutory principles the Judge set a starting point of 2 years 6 months imprisonment, applied modest discounts for prior good character (5%) and remorse (5%), credited four months for strict EM bail, and exercised discretion to impose eight months' home detention because imprisonment would be disproportionate to culpability and sentencing purposes could be met by a community-based sentence.

Fresh evidence applications declined; the starting point of nine years was excessive for impulsive, non‑premeditated GBH causing non‑enduring injury and better assessed at six years six months; discrete uplift for the index breach of protection order removed as double counting and prior breaches warranted only a two month uplift; PTSD causally contributing to offending justified increasing the mental health discount to 20%; applying a 20% guilty plea discount produced an end sentence of four years three months which substituted the original six years nine months.

The sentencing judge's overall starting point was manifestly inadequate. The correct approach identified the lead offence starting point at the boundary of Taueki bands 2–3 with cumulative uplifts producing a higher notional starting point, but having regard to appellate restraint and the Crown's concession about range the Court substituted an increased global sentence: eight years and six months' imprisonment with a minimum period of four years and three months.

The High Court held the District Court sentence was not manifestly excessive and should be upheld. The Court endorsed an orthodox assessment: set an appropriate starting point for the demanding with menaces (within the Regan/Opetaia/Witute spectrum), uplifted for associated theft and multiple driving and other offences, imposed a further uplift for offending on bail, and allowed discounts for youth and guilty plea; overall the original sentence of three years' imprisonment fell within the available range and the appeal was dismissed.

The Court held the offending fell within the higher end of rape band two and that an 11‑year starting point was available and appropriate given multiple and serious aggravating factors; the 20% guilty plea reduction to an effective sentence of eight years and ten months was proper; psychiatric evidence did not establish a causal role of active psychosis at the time of the offence nor that imprisonment was rendered less appropriate by mental disorder, so no reduction for mental health was warranted.

The High Court allowed the appeal in part because fresh psychiatric material demonstrating a personality disorder linked to lifelong neurological impairment reduced overall culpability by about six months; however, the offending remained sufficiently serious that home detention remained inappropriate and imprisonment was required, so the two‑year sentence was quashed and replaced with 18 months imprisonment, with directions for psychological assessment and treatment in custody and on release.

The High Court found the appropriate starting point for the eight residential burglaries was 3 years 6 months with a 12 month uplift for related offending (total 4 years 6 months), applied modest discounts for mental health and EM bail and a 25% guilty plea reduction, producing an end sentence effectively consistent with the District Court's three year term; the sentence was therefore not manifestly excessive and the appeal was dismissed.
