The constructive trust claim failed for lack of evidence of material contributions and reasonable proprietary expectation; the deceased breached her moral duty under the Family Protection Act to the second and third defendants and the will is varied to award each $950,000 from the estate; Australian assets were considered for valuation but orders apply only to New Zealand assets.

The Court held the Family Court judge correctly found a moral duty was breached, that the evidence (affidavits and disclosed documents) was sufficient to establish Keith Parker's need for maintenance, and that the discretionary awards of $100,000 to Helen Tigg and $175,000 to Keith Parker were within the available range and not plainly wrong on appeal; accordingly the appeal was dismissed.

The court held that the testatrix understood and approved the 2011 will in the legal sense; feelings of reluctance or being 'backed into a corner' do not amount to lack of approval or undue influence absent evidence that the will did not reflect her testamentary intentions, and therefore the appeal must be dismissed.
