The review is dismissed because inclusion of two judgment debts in the single bankruptcy notice did not demonstrably prejudice Mr Kelly (he could have paid the undisputed costs and contested the other debt), there was no necessity to adjourn at this stage because Mr Kelly can raise the re-hearing fixture when opposing the adjudication application, and the asserted cross-claim lacked standing and realistic prospect of success because trust claims require trustee concert and a co-trustee is in liquidation.
