Beatbox established a good arguable case that its claims against Labrador fall within r 6.27 and that there is a serious issue to be tried; the choice of law wording did not constitute a clear exclusive jurisdiction clause in favour of California and New Zealand is the appropriate forum for resolution of the interconnected disputes; accordingly Labrador's appearance and objection to jurisdiction was set aside and the Court assumed jurisdiction.
