The appeal is allowed because the review decision failed to determine the factual date on which ACC possessed all information necessary to calculate and make the arrears payment; that factual date (one month after which interest crystallises) determines which statutory provision applies under the transitional regime, so the matter is remitted for review to analyse and fix that factual date.
