The application for an extension of time was dismissed because there was no reasonable explanation for the over one-year delay and, in any event, the proposed appeal did not meet the statutory leave criteria; consequently leave would have been refused and costs of $2,500 were awarded against the first applicant with no costs against the second applicant due to the Official Assignee issue.
