The Court found on the balance of probabilities that the 17 May 2008 accident produced the final step causing nerve root compression requiring posterior foraminotomy; pre‑existing degenerative foraminal narrowing was asymptomatic and did not preclude ACC liability, so ACC must fund the surgery.
