The Tribunal erred in law by considering the appellant's non-disclosure and related character issues as part of the first limb inquiry into whether there were 'exceptional circumstances of a humanitarian nature' under s207(1)(a); such matters properly inform the 'unjust or unduly harsh' enquiry, but the error was immaterial because the appellant's circumstances were not exceptional and the Tribunal's decision to dismiss the appeal is confirmed.
