The freezing order was discharged because the applicant's without‑notice affidavit failed to make full and fair disclosure of material facts that were directly relevant to the necessity and propriety of the order (notably the true status and value of the Blockhouse Bay property and evidence of the parents' equitable interest in the apartment); with proper disclosure a judge would not have granted the freezing order, so the order must be set aside.
