The Court affirmed the High Court's principled exercise of discretion: Oraka was the successful party for the damages hearing despite modest recovery; the 2015 offer (made by NTD) did not give Geostel an automatic r14.11 entitlement and its rejection was not unreasonable; the 2017 offer did not mandate reversal of costs because it was not a clear money offer, was late and uncertain in value; and this appeal could not be used to revisit or adjust the unrelated 2013 costs award.
