The court granted extinguishment under s 317 because the covenants had become obsolete due to rezoning and change of neighbourhood character to residential, the covenants would impede reasonable use of the servient land and some affected land must vest free of encumbrances under the RMA, and the extinguishment would not substantially injure any beneficiary.
