Given the premeditated, multi-year diversion of approximately NZD 1.3 million and breach of trust, a starting point of four years' imprisonment was appropriate; that starting point was reduced by significant mitigating factors (first offender, age, community standing, remorse (5%) and guilty pleas (25%), totalling a reduction to two years) and, applying the sentencing objectives of deterrence, denunciation and rehabilitation while preferring the least restrictive appropriate outcome, the Court imposed home detention: 12 months on each charge to be served concurrently with specified conditions.
