The Court held ACC validly determined the appellant's capacity for work: vocational rehabilitation obligations were satisfied, the original occupational assessment remained usable despite revocation of the earlier medical assessor, Dr Kahan met s98 and his medical assessment could be relied upon, and later medical reports produced after the review hearing did not demonstrate the earlier assessment was wrong; accordingly ACC's decision that the appellant had capacity to work and ceased to be entitled to weekly compensation was confirmed.
