The Supreme Court (majority) dismissed the appeal and refused to grant a permanent restraint on broadcasting: the videotaped reconstruction and interview did not attract a privacy right sufficient to justify prior restraint in the circumstances, open justice and freedom of expression weighed heavily in favour of broadcast after the trial, and exclusion of the tape at trial adequately vindicated the Bill of Rights breaches; prior restraint requires clear, exceptional justification which was not established here.
