The Court found the plaintiff has a good arguable case on contract, misrepresentation and Companies Act claims, there are assets to which the order can apply, and there is a real danger of dissipation via transfers to overseas entities and shareholder drawings; accordingly the interim freezing order should not be discharged and is continued until substantive judgment, and ancillary disclosure orders are appropriate to police the order, while leave is reserved to vary the order and costs are reserved.
