The Court held there was no question of law for the Court of Appeal because the arbitrator properly found as a fact that the buses were ordered off by a Vehicle Safety Officer and the fact that the decision was conveyed to the applicant by a police constable did not negate compliance with clause 87.3; therefore leave to appeal was refused.
