The Court held that a 2B costs order should be made against the first and second respondents and against Murray John Withers personally, jointly and severally, because the litigation and costs resulted directly from transactions orchestrated and controlled by Mr Withers intended to hinder and defeat creditors; although non-party cost orders are exceptional, the facts justified personal liability for costs; however, requested uplifts for specific steps were not warranted and were declined.
