Applicant discharged the onus by adducing credible evidence of a substantial dispute and set-offs (including denial of access to the overdraft, identified payments by applicant for respondent's liabilities, and an unpaid portion of contractual WIP deposits totalling an aggregate disputed/set-off amount of $69,137.29) which exceeded the first part of the statutory demand ($51,162.76); accordingly the statutory demand was set aside and the substantive conflicts are to be resolved in ordinary proceedings.
