Section 252(6) requires WINZ benefit payments to be treated as having been paid as compensation for the same period regardless of ACC's prior unlawful decision; interest under s114 is payable only on the excess after crediting those deemed payments; the applicant's submissions do not raise a bona fide and serious question of law because Cullen and the Court of Appeal have already determined the issue, so leave is refused.
