Applying s4(1) as paramount and the approach in H v A, the court declined to award costs to TEJ because awarding costs against ROJ would be inconsistent with the welfare and best interests of the children: the appeal was finely poised, ROJ's concerns were legitimate, neither party was plainly blameworthy on the appeal, both incurred substantial costs and ROJ was not better placed to meet an adverse costs order.
