The Council acted unlawfully in granting the resource consent on a non-notified basis because it did not have adequate information to understand the nature and scope of the proposed activity, assess the magnitude of adverse effects (notably traffic/parking and noise from machinery), or identify affected persons; the consent was set aside and the Council must reconsider any further application with proper inquiry and notification/service as required.
