On remission the Court applied the Court of Appeal's findings that the High Court had failed to apply r14.7(d) and had underestimated the impact of late insurance disclosure; the prior costs orders dated 16 September 2020 are confirmed except that costs payable to the first defendant are reduced by 15% and the costs orders for the recall and supplementary hearings are quashed with no order made as to those recall/supplementary hearing costs (those costs therefore lie where they fall).
