The Court assessed the proceeding as Category 2 (average complexity) and awarded costs to the applicant against the first respondent in accordance with the applicant's schedule dated 17 June 2019 with all items calculated on a 2B basis except item 40 (preparation of written submissions) which was allowed on a 2C basis due to urgency and the quality of submissions; the Court also awarded costs to the second respondent against the first respondent on a 2A basis because the second respondent had to incur costs as a result of the lodged notice of claim despite advising it would abide.
