There was a serious issue to be tried and the balance of convenience favoured maintaining the interim injunction because the grapes were perishable and the defendant's inability to pay damages meant damages would not be an adequate remedy for the plaintiff; accordingly the interlocutory injunction previously granted was not set aside and remains until further order.
