On the balance of probabilities the PVL was an in‑utero condition related to maternal diabetes present at birth; there was insufficient evidence that post‑natal treatment or delay caused the PVL and, in any event, the injury was wholly or substantially caused by the underlying condition (maternal diabetes), so the statutory definition of treatment injury was not met and ACC's declinature was correct.
