Leave to bring a second appeal was declined because the appeal did not raise any matter of general or public importance and there was no risk of miscarriage of justice; the sentencing judge had taken the applicant's personal circumstances into account and no special sentencing rules for returning offenders are required.

The appeal was dismissed because the appellant failed to prove on the balance of probabilities the alleged $8,000 repayment and the Judge did not err in declining to give further credit for personal circumstances given the appellant's 38 prior dishonesty convictions and offending while subject to post-detention conditions; the sentencing Judge acted within permissible discretion and correctly applied s24 standards of proof.

Dismissal of leave was justified because there was no adequate factual basis to treat the prison assault and resulting injury as a mitigating personal circumstance or NZBORA breach, and because even if a discount were appropriate the same end sentence could likely have been imposed given prior uplift for other serious offending.
