The Court reduced the uplift for prior convictions from three months to one month because any uplift must be proportionate to prior sentences (which were non-custodial); increased the personal discount from 15% to 25% because the s38 report and psychiatric material demonstrated severe background trauma, cannabis dependence and probable psychotic illness; after applying those adjustments and totality the appropriate sentence is five months' imprisonment with leave to apply for home detention and confirmation of cancellation of 80 hours community work.
